Terms & Conditions

In these terms the following definitions apply:

• Cooling-off period, the period within which a consumer can exercise their right of withdrawal.
• Consumer, a natural person not acting in the course of a profession or business who enters into a distance agreement with us.
• Day, a calendar day.
• Right of withdrawal, the option for the consumer to cancel the distance agreement within the cooling-off period.
• Distance agreement, an agreement concluded solely through one or more means of distance communication.
• Entrepreneur, the party offering products at a distance to consumers (Pineapple Drinks Club).

These terms apply to every offer and to every distance agreement and order concluded between us and a consumer. Before the agreement is concluded, this text is made available to the consumer; where reasonably possible, in a form that can be stored on a durable medium. If any provision is void or annulled, the agreement and remaining terms stay in force and the provision is replaced by one that approximates its intent as closely as possible. Situations not covered by these terms are assessed in their spirit.

Where an offer has a limited period of validity or conditions, this is stated explicitly. The offer is without obligation and we may amend it. Offers contain a complete, accurate description of the products, sufficient for a proper assessment. Images are a truthful representation; we cannot guarantee that displayed colours exactly match the real product. Obvious errors or mistakes do not bind us. Every offer makes clear the consumer’s rights and obligations, including the price inclusive of taxes, any shipping costs, the method of payment and delivery, and whether the right of withdrawal applies.

The agreement takes effect when the consumer accepts the offer and meets the associated conditions. Where accepted electronically, we confirm receipt without delay; until we do, the consumer may dissolve the agreement. We take appropriate technical and organisational measures to secure electronic data transfer and provide a safe web environment, including for electronic payment. Every agreement is entered into subject to sufficient availability of the products concerned.

When buying products, the consumer may dissolve the agreement without giving reasons for 14 days. This period starts the day after the consumer (or a nominated representative) receives the product. During this time the consumer handles the product and packaging with care, unpacking or using it only as far as needed to assess whether to keep it. To exercise the right, the consumer notifies us within 14 days of receipt, via the model form or another means such as email, and returns the product within a further 14 days. The consumer must prove that goods were returned in time (e.g. a proof of postage).

The consumer bears the direct cost of returning the product. Any amount paid is refunded as soon as possible and within 14 days of withdrawal, provided we have received the product back or been shown conclusive proof of complete return. Refunds use the same payment method the consumer used, unless they expressly agree otherwise. Where a product is damaged through the consumer’s careless handling, the consumer is liable for any resulting loss of value.

We may exclude the right of withdrawal for certain products, only if stated clearly in the offer or in good time before the agreement. Exclusion is possible for products made to the consumer’s specification, products that are clearly personal, products that cannot be returned by their nature, products that perish or age quickly, and sealed hygiene products whose seal has been broken.

During the validity period stated in the offer, prices are not increased except for VAT rate changes. Prices of products offered are inclusive of VAT. All prices are subject to printing and typesetting errors; we accept no liability for the consequences of such errors and are not obliged to deliver at an erroneous price.

We warrant that products meet the agreement, the specifications stated, reasonable requirements of soundness and usability, and the statutory provisions in force at the time of the agreement. The statutory warranty applies to all products; its duration may vary by the nature of the product. Defects or wrongly delivered products should be reported in writing within two months of discovery. The warranty does not apply where the consumer has repaired or altered the goods themselves, or exposed them to abnormal conditions.

We take the greatest possible care in receiving and executing orders. The place of delivery is the address the consumer has provided. We execute accepted orders promptly and within 30 days at the latest, unless a longer delivery period has been agreed. If delivery is delayed or an order cannot be (fully) executed, the consumer is informed within 30 days and may dissolve the agreement without cost. The risk of damage or loss rests with us until delivery to the consumer or a nominated representative, unless expressly agreed otherwise.

For agreements of indefinite duration covering the regular delivery of products, the consumer may terminate at any time with due observance of the agreed rules and a notice period of no more than one month. Fixed-term continuing agreements may not be silently renewed or extended for a fixed term, subject to the statutory exceptions.

Unless agreed otherwise, amounts owed by the consumer are due within the applicable statutory period. The consumer must report inaccuracies in payment details provided to us without delay. In the event of non-payment, and subject to statutory limits, we may charge reasonable costs made known to the consumer in advance.

We have a clearly published complaints procedure. Complaints about the performance of the agreement must be submitted fully and clearly within two months of the consumer noticing the defect. We respond within 14 days of receipt; where a complaint needs a foreseeably longer processing time, we reply within 14 days with an acknowledgement and an indication of when a fuller answer can be expected. A complaint does not suspend our obligations unless we indicate otherwise in writing.

Agreements between us and the consumer to which these terms relate are governed exclusively by Dutch law, even if the consumer lives abroad. The Vienna Sales Convention does not apply.

Additional provisions, or provisions deviating from these terms, may not be to the consumer’s detriment and must be recorded in writing or in a way that lets the consumer store them on a durable medium.
